Terms and Conditions of Use for Fitness RX LLC

Welcome to Fitness RX LLC ("Fitness RX," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your use of our services, including our website, mobile application(s), telehealth services, community forums, and subscription offerings for GLP-1 medications (collectively, the "Services").
By accessing or using any of our Services, you agree to be bound by these Terms and our Privacy Policy, including our Notice of Privacy Practices under HIPAA.
1. Eligibility
You must:
- Be at least 18 years of age,
- Reside in the United States, and
- Be capable of entering into a legally binding agreement.
By using our Services, you represent and warrant that you meet all of the above eligibility requirements.
2. Medical Services and Consent to Telehealth
Fitness RX offers access to licensed healthcare providers for consultations and prescriptions related to GLP-1 medications for weight loss. By using our Services, you:
- Acknowledge that you are voluntarily participating in a telehealth consultation.
- Consent to receive treatment and communication via electronic means, including messaging, video, and audio.
- Understand that telehealth may not be as complete as in-person care.
- May withdraw your consent at any time by discontinuing use of the Services.
Not Medical Advice: Our Services are not a substitute for your relationship with your primary care provider. In case of a medical emergency, call 911.
3. HIPAA and Privacy Compliance
We are committed to protecting your health information under the Health Insurance Portability and Accountability Act (HIPAA). 4. Subscription Services
a. Recurring Billing: Our Services are offered on a subscription basis. You authorize recurring billing using your selected payment method.
b. Cancellation: Subscriptions may be canceled anytime via your account dashboard. Cancelations apply at the end of the current billing cycle.
c. Third-Party Pharmacies: Medications prescribed through our Services may be fulfilled by third-party licensed pharmacies. By using our Services, you authorize the sharing of necessary medical and personal data with these pharmacies.
d. Medication Quantity and Plan Adjustments: If your provider determines that additional or higher-dose medication is medically necessary, we will notify you of any associated increase in cost and may recommend a different subscription plan better suited to your needs, and no additional charges will be applied without your consent.
5. Shipping & Refund Policy
Shipping Policy
We are committed to ensuring that your products are delivered safely, securely, and in a timely manner.
- Shipping Rates: Shipping fees range from $5 to $20, depending on the medicine/product and delivery destination. The exact shipping cost will be calculated at checkout.
- Refrigerated Shipping: Certain medications and products require temperature-controlled packaging. These items are shipped using refrigerated methods to maintain product safety and effectiveness.
- Processing Time: Orders are typically processed within 2-3 business days. Shipping times may vary depending on your location and carrier availability.
Refund Policy
Due to the nature of our products, we do not accept returns or issue refunds once an order has been processed and shipped. This policy helps us ensure the safety, integrity, and quality of all medications and health-related products.
- Final Sale: All purchases are considered final.
- Damaged or Incorrect Orders: If you receive a product that is damaged, defective, or incorrect, please contact our support team within 48 hours of delivery. We will review the issue and, if verified, arrange for a replacement at no additional cost to you.
- Prescription Medications: For safety and regulatory reasons, prescription medications cannot be returned or refunded under any circumstances.

6. User Conduct in Community and App
If you use our app or participate in any community features (such as forums, group chats, or messaging), you agree to the following:

- Do not post or share content that is offensive, obscene, threatening, misleading, harmful, or otherwise inappropriate.
- Do not impersonate any individual or entity, or misrepresent your affiliation with any person or organization.
- Do not violate any applicable laws, regulations, or third-party rights.
- No solicitation of any kind is allowed. This includes, but is not limited to, promoting products or services, recruiting users for other programs, or posting advertisements, links, or affiliate offers.
- We reserve the right to monitor community activity and suspend or terminate your access at any time and for any reason, including violations of these rules.
7. Account Security
You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use or suspected breach of your account.
8. Intellectual Property
All content, branding, software, and technology provided through our Services are the property of Fitness RX or its licensors. You may not copy, distribute, or exploit any part of our Services without express written consent.
9. Limitation of Liability
To the fullest extent permitted by law, Fitness RX and its affiliates will not be liable for any indirect, incidental, or consequential damages arising from the use of our Services.
Our liability for direct damages will be limited to the amount paid by you for the Services in the prior 12 months.
10. Arbitration and Class Action Waiver
a. Binding Arbitration: Any disputes will be resolved by binding arbitration administered by the American Arbitration Association in Miami, FL.
b. No Class Actions: You agree to resolve disputes on an individual basis and waive any right to participate in a class action.
c. Opt-Out: You may opt out of arbitration by notifying us in writing within 30 days of your first use of the Services.
11. Modifications to Terms
We may update these Terms at any time. Changes will be posted on our website or app. Continued use of the Services constitutes acceptance of the updated Terms.
12. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.
